بمناسبة اليوم الدولي لمساندة ضحايا التعذيب

بمناسبة اليوم الدولي لمساندة ضحايا التعذيب، الذي يوافق 26 حزيران/يونيو من كل عام، يؤكد مركز القانون الدولي الإنساني وحقوق الإنسان (CIHLHR) تضامنه الكامل مع جميع ضحايا التعذيب في أنحاء العالم، ويجدد التزامه بالدفاع عن الكرامة الإنسانية، ومناهضة التعذيب بكافة أشكاله وصوره، والعمل من أجل ضمان المساءلة والعدالة وعدم الإفلات من العقاب.

ويحمل هذا اليوم دلالة قانونية وإنسانية بالغة الأهمية، إذ يوافق ذكرى دخول اتفاقية الأمم المتحدة لمناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة حيز النفاذ في 26 حزيران/يونيو 1987، وهي الاتفاقية التي أصبحت إحدى الركائز الأساسية لحماية الإنسان من التعذيب، وانضمت إليها حتى اليوم 174 دولة طرفاً، بما يعكس توافقاً دولياً واسعاً على تجريم هذه الممارسة وحظرها بصورة مطلقة.

ويُعرَّف التعذيب بأنه أي فعل يُلحق عمداً ألماً أو معاناة شديدة، جسدية كانت أم نفسية، بشخص ما بقصد الحصول على معلومات أو اعتراف، أو معاقبته، أو تخويفه، أو التمييز ضده، عندما يُرتكب ذلك من قبل موظف رسمي أو بموافقته أو برضاه. ويُعد التعذيب انتهاكاً صارخاً للكرامة الإنسانية، ولا يجوز تبريره تحت أي ظرف، سواء في حالات الحرب أو الطوارئ أو مكافحة الإرهاب أو أي مبررات أخرى.

ويستند الحظر المطلق للتعذيب إلى منظومة متكاملة من المعايير والصكوك القانونية الدولية والوطنية، وفي مقدمتها اتفاقية الأمم المتحدة لمناهضة التعذيب، والبروتوكول الاختياري لاتفاقية مناهضة التعذيب، الذي أنشأ نظاماً للزيارات الوقائية لأماكن الاحتجاز، إضافة إلى الإعلان العالمي لحقوق الإنسان الذي نص في مادته الخامسة على أنه: "لا يجوز إخضاع أحد للتعذيب ولا للمعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة." كما يكرس القانون الدولي الإنساني والقانون الدولي لحقوق الإنسان هذا الحظر باعتباره قاعدة آمرة لا يجوز الانتقاص منها.

ويؤكد المركز أن ممارسة التعذيب على نحو منهجي أو واسع النطاق ضد السكان المدنيين قد ترقى إلى جريمة ضد الإنسانية بموجب القانون الجنائي الدولي، الأمر الذي يستوجب ملاحقة المسؤولين عنها ومحاسبتهم، وعدم السماح بالإفلات من العقاب.

ويجدد مركز القانون الدولي الإنساني وحقوق الإنسان رفضه القاطع لجميع المبررات أو الذرائع التي تُستخدم لتسويغ التعذيب، ويؤكد أن لا عذر ولا استثناء يجيز استخدام التعذيب تحت أي ظرف أو لأي سبب، وأن احترام الكرامة الإنسانية وسيادة القانون يمثلان أساس العدالة والسلام.

كما يؤكد المركز التزامه الثابت بمناهضة جريمة التعذيب، ومواصلة جهوده في رصد وتوثيق جميع الانتهاكات التي تمس الكرامة الإنسانية، والدفاع عن حقوق الضحايا، وتعزيز الوعي القانوني، ودعم المساءلة والإنصاف، بما يسهم في منع تكرار هذه الجرائم.

وبهذه المناسبة، يدعو مركز القانون الدولي الإنساني وحقوق الإنسان (CIHLHR) كافة أصحاب المصلحة، بما في ذلك الدول الأعضاء في الأمم المتحدة، والهيئات الوطنية، والمؤسسات القضائية، ومنظمات المجتمع المدني، ووسائل الإعلام، والأفراد في كل مكان، إلى توحيد الجهود والتكاتف دعماً لمئات الآلاف من ضحايا التعذيب في مختلف أنحاء العالم، وإلى توفير الحماية والإنصاف وجبر الضرر للضحايا، والعمل على إنهاء هذه الممارسات التي لا تزال مستمرة حتى اليوم.

ويشدد المركز على أن مرتكبي جرائم التعذيب يجب ألا يُسمح لهم أبداً بالإفلات من العقاب، وأن الأنظمة والسياسات والممارسات التي تمكّن التعذيب أو تتسامح معه يجب تفكيكها أو إصلاحها بما يضمن احترام حقوق الإنسان، وتعزيز استقلال القضاء، وإخضاع أماكن الاحتجاز للرقابة الفعالة، وترسيخ سيادة القانون.

إن القضاء على التعذيب ليس مجرد التزام قانوني، بل هو واجب إنساني وأخلاقي، وخطوة أساسية لبناء مجتمعات يسودها العدل والكرامة واحترام حقوق الإنسان.

On the International Day in Support of Victims of Torture

On the occasion of the International Day in Support of Victims of Torture, observed annually on 26 June, the Center for International Humanitarian Law and Human Rights (CIHLHR) expresses its full solidarity with victims of torture around the world and reaffirms its unwavering commitment to defending human dignity, combating torture in all its forms, and promoting accountability, justice, and an end to impunity.

This day carries profound legal and humanitarian significance, as it marks the anniversary of the entry into force of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment on 26 June 1987. The Convention has become one of the fundamental international instruments for the protection of individuals from torture and now has 174 States Parties, reflecting the broad international consensus that torture is an absolute and universally prohibited crime.

Torture is defined as any act by which severe physical or mental pain or suffering is intentionally inflicted on a person for such purposes as obtaining information or a confession, punishment, intimidation, coercion, or discrimination, when such pain or suffering is inflicted by, or with the consent or acquiescence of, a public official or another person acting in an official capacity. Torture constitutes a grave violation of human dignity and can never be justified under any circumstances, including armed conflict, states of emergency, or counter-terrorism efforts.

The absolute prohibition of torture is firmly established in international and national legal frameworks, particularly through the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, its Optional Protocol (OPCAT), which established a preventive system of regular visits to places of detention, and the Universal Declaration of Human Rights, whose Article 5 states: “No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.” International humanitarian law and international human rights law likewise recognize the prohibition of torture as a peremptory norm (jus cogens) from which no derogation is permitted.

The Center further emphasizes that the systematic or widespread practice of torture against civilian populations may constitute a crime against humanity under international criminal law, requiring the prosecution of those responsible and ensuring that no perpetrator enjoys impunity.

The Center for International Humanitarian Law and Human Rights unequivocally rejects all justifications or pretexts invoked to legitimize torture and reiterates that there is no excuse, exception, or circumstance that can ever justify the use of torture. Respect for human dignity and the rule of law must remain the cornerstone of justice and peace.

The Center also reaffirms its steadfast commitment to combating torture through the monitoring and documentation of all violations of human dignity, advocating for victims' rights, promoting legal awareness, and supporting accountability and effective remedies to prevent the recurrence of such grave violations.

On this occasion, the Center for International Humanitarian Law and Human Rights (CIHLHR) calls upon all stakeholders—including United Nations Member States, national institutions, judicial authorities, civil society organizations, media institutions, and individuals worldwide—to unite their efforts in support of the hundreds of thousands of torture victims across the globe, to provide protection, justice, rehabilitation, and reparations for survivors, and to work collectively to eradicate torture wherever it persists.

The Center further stresses that perpetrators of torture must never be allowed to escape accountability, and that the systems, institutions, and policies that enable or tolerate torture must be dismantled or fundamentally reformed to ensure respect for human rights, strengthen judicial independence, provide effective oversight of places of detention, and uphold the rule of law.

The eradication of torture is not only a legal obligation but also a moral and humanitarian imperative. It is an essential prerequisite for building societies founded on justice, human dignity, and respect for human rights.

On the Occasion of International Women’s Day – 8 March

The International Humanitarian Law and Human Rights Center marks International Women’s Day observed annually on 8 March, as an important global occasion to renew the international commitment to protecting and promoting the rights of women and girls and to highlight the serious challenges and violations they continue to face—particularly in situations of armed conflict and humanitarian crises.

On this occasion, the Center affirms that women’s rights are an integral and inseparable part of the universal human rights system as guaranteed by international legal instruments including the Universal Declaration of Human Rights the International Covenant on Civil and Political Rights and the International Covenant on Economic Social and Cultural Rights, in addition to specialized international treaties dedicated to the protection of women’s rights.

The Center expresses its strong condemnation and categorical rejection of all forms of violations committed against women and girls in Yemen and in conflict-affected areas around the world including gender-based violence sexual violence exploitation forced marriage discrimination deprivation of access to education and employment arbitrary detention abduction forced displacement and other forms of abuse
that undermine their dignity and fundamental rights
Such violations constitute grave breaches of international human rights law and international humanitarian law.

The Center further emphasizes that international humanitarian law, particularly the Geneva Conventions of 1949 and their Additional Protocols of 1977 provides special protections for women during armed conflicts.
These legal frameworks prohibit violence against civilians,
including sexual violence, outrages upon personal dignity and cruel inhuman, or degrading treatment and obligate all parties to a conflict to respect and ensure the protection of civilians without discrimination.
The Center also highlights the central importance of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) which constitutes the primary international legal framework for the protection of women’s rights and obliges States Parties to adopt legislative administrative and judicial measures to eliminate discrimination against women in all spheres of life.

Furthermore, the Center underscores the significance of the Beijing Declaration and Platform for Action (1995) which represents a historic global commitment to advancing gender equality and women’s empowerment and calls for the elimination of violence and discrimination against women and the promotion of their full and equal participation in public life.
The Center also reiterates the importance of United Nations Security Council Resolution 1325 on Women Peace and Security, which affirms the necessity of ensuring women’s meaningful participation in decision-making processes, peacebuilding, conflict prevention and post-conflict reconstruction, while guaranteeing their protection from violence related to armed conflict.
In this context the Center stresses that gender equality is not merely a fundamental human right; it is an essential foundation for building peaceful, just and sustainable societies.

Empowering women and girls and ensuring their equal participation in political, economic, and social life are critical pillars for achieving stability, development, and social justice.
The Center further emphasizes the importance of advancing Sustainable Development Goal 5, which calls for achieving gender equality and empowering all women and girls including ensuring their effective participation in decision-making at all levels and strengthening their role in peacebuilding and sustainable development.
In light of the above, the International Humanitarian Law and Human Rights Center calls upon all parties in Yemen, national authorities, and the international community to:

1- Fully comply with international humanitarian law and international human rights law and ensure the protection of women and girls in situations of armed conflict.
2- Combat impunity and ensure accountability for all crimes and violations committed against women.
3- Promote women’s meaningful participation in decision-making and peacebuilding processes in accordance with the principles of UN Security Council Resolution 1325.
4- Develop and reform national legislation and policies to align with Yemen’s international obligations under CEDAW and other relevant human rights instruments.
5- Support programs that empower women economically, socially, and educationally, contributing to sustainable development and inclusive peace.

In conclusion the International Humanitarian Law and Human Rights Center reaffirms its commitment to continue working toward documenting violations advocating for the rights of women and girls and promoting equality and justice, in cooperation with national and international partners, in order to build a society that respects human dignity and guarantees equal rights for all without discrimination.

يحيي مركز القانون الدولي الإنساني وحقوق الإنسان اليوم العالمي للمرأة الذي يصادف 8 مارس من كل عام باعتباره مناسبة دولية لتجديد الالتزام العالمي بحماية وتعزيز حقوق النساء والفتيات وتسليط الضوء على التحديات والانتهاكات الجسيمة التي لا تزال تتعرض لها النساء خصوصًا في مناطق النزاعات المسلحة والأزمات الإنسانية.

وفي هذه المناسبة يؤكد المركز أن حقوق المرأة جزء لا يتجزأ من منظومة حقوق الإنسان العالمية التي كفلتها المواثيق والاتفاقيات الدولية وفي مقدمتها الإعلان العالمي لحقوق الإنسان والعهد الدولي الخاص بالحقوق المدنية والسياسية والعهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية إلى جانب الاتفاقيات المتخصصة المعنية بحماية حقوق المرأة.

ويعرب المركز عن إدانته ورفضه القاطع لكافة أشكال الانتهاكات التي تتعرض لها النساء والفتيات في اليمن وفي مختلف مناطق النزاعات المسلحة حول العالم بما في ذلك أعمال العنف القائم على النوع الاجتماعي والاعتداءات الجنسية والاستغلال والزواج القسري والحرمان من التعليم والعمل والتمييز القانوني والاجتماعي والاعتقال التعسفي والاختطاف والتجنيد القسري والنزوح القسري وتشكل هذه الانتهاكات انتهاكًا صارخًا للقانون الدولي لحقوق الإنسان والقانون الدولي الإنساني.

ويؤكد المركز أن القانون الدولي الإنساني ولا سيما اتفاقيات جنيف لعام 1949 والبروتوكولان الإضافيان لعام 1977 يوفر حماية خاصة للنساء أثناء النزاعات المسلحة ويحظر كافة أشكال الاعتداء على الكرامة الشخصية والعنف الجنسي والمعاملة القاسية أو اللاإنسانية أو المهينة.
كما يفرض على أطراف النزاع احترام مبدأ حماية المدنيين وضمان المعاملة الإنسانية لجميع الأشخاص دون تمييز.

كما يشير المركز إلى أن اتفاقية القضاء على جميع أشكال التمييز ضد المرأة (CEDAW) تُعد الإطار الدولي الأساسي لحماية حقوق النساء حيث تُلزم الدول الأطراف باتخاذ التدابير التشريعية والإدارية والقضائية للقضاء على التمييز ضد المرأة في جميع المجالات السياسية والاقتصادية والاجتماعية والثقافية.
ويؤكد المركز كذلك أهمية إعلان ومنهاج عمل بكين لعام 1995 الذي شكل محطة تاريخية في تعزيز حقوق المرأة عالميًا حيث دعا إلى تمكين النساء وضمان مشاركتهن الكاملة والمتساوية في الحياة العامة وتعزيز الحماية من جميع أشكال العنف والتمييز.

كما يشدد المركز على الدور المحوري لقرار مجلس الأمن رقم 1325 بشأن المرأة والسلام والأمن الذي يؤكد ضرورة إشراك النساء بشكل فاعل في عمليات صنع القرار وبناء السلام ومنع النزاعات وإعادة الإعمار بعد النزاعات مع ضمان حمايتهن من العنف المرتبط بالنزاعات المسلحة.

وفي هذا السياق يؤكد المركز أن المساواة بين الجنسين ليست مجرد حق أساسي من حقوق الإنسان بل هي قاعدة أساسية وشرط جوهري لبناء مجتمعات يسودها السلام والعدالة والتنمية المستدامة.
فتمكين النساء والفتيات وتعزيز مشاركتهن الفاعلة في الحياة السياسية والاقتصادية والاجتماعية يمثل ركيزة أساسية لتحقيق الاستقرار والتنمية.

كما يشدد المركز على أهمية العمل الجاد لتحقيق الهدف الخامس من أهداف التنمية المستدامة المتمثل في تحقيق المساواة بين الجنسين وتمكين جميع النساء والفتيات بما يضمن مشاركتهن الفاعلة في صنع القرار على جميع المستويات وتعزيز دورهن في تحقيق السلام والتنمية المستدامة.

وفي ضوء ذلك يدعو مركز القانون الدولي الإنساني وحقوق الإنسان جميع الأطراف في اليمن والسلطات الوطنية والمجتمع الدولي إلى:
1- الالتزام الكامل بقواعد القانون الدولي الإنساني والقانون الدولي لحقوق الإنسان وضمان حماية النساء والفتيات أثناء النزاعات المسلحة.
2- مكافحة الإفلات من العقاب وضمان المساءلة القانونية عن جميع الجرائم والانتهاكات المرتكبة بحق النساء.
3- تعزيز مشاركة المرأة في عمليات صنع القرار وبناء السلام وفقًا لمبادئ قرار مجلس الأمن 1325.
4- تطوير التشريعات والسياسات الوطنية بما ينسجم مع التزامات اليمن الدولية بموجب اتفاقية CEDAW والمواثيق الدولية ذات الصلة.
5- دعم برامج تمكين النساء اقتصاديًا واجتماعيًا وتعليميًا بما يسهم في تحقيق التنمية المستدامة.

وفي الختام يجدد مركز القانون الدولي الإنساني وحقوق الإنسان التزامه بمواصلة جهوده في رصد وتوثيق الانتهاكات والدفاع عن حقوق النساء والفتيات وتعزيز مبادئ المساواة والعدالة والعمل مع الشركاء الوطنيين والدوليين من أجل بناء مجتمع يحترم الكرامة الإنسانية ويكفل الحقوق المتساوية للجميع دون تمييز.

March 8 isn’t just a date. It’s a reminder that the leadership gender gap is still real.

Women now match or surpass men in education and early career participation, yet they’re still underrepresented in executive roles. Why?
