That’s the foundation of the disconnect defense.

When jurors watch a client drive safely, speak clearly, follow directions, and demonstrate normal motor skills, a high breath-test result may begin to look like the one piece of evidence that simply doesn’t fit.

Hunter Tzovarras walks through a real OUI trial where the Intoxilyzer showed 0.16, yet the jury ultimately returned a not guilty verdict.

The lesson is powerful: the defense doesn’t always have to prove exactly why the machine is wrong. The State still has to prove that it’s right beyond a reasonable doubt.

But what happens when the person on the body-camera video doesn’t look impaired at all?

That was the challenge facing NCDD Trial Advocacy Task Force Chair Hunter Tzovarras in a Maine OUI trial. The breath test showed twice the legal limit, yet the client’s driving, speech, motor skills, demeanor, and behavior told a very different story.

The defense focused on that contradiction.
