A new AICWA President’s Bulletin is now available for members.
The bulletin addresses recent commentary from REIWA and the practical challenges arising from the implementation of AML/CTF Tranche 2.
It covers REIWA’s acknowledgement that settlement agents are not legally obliged to agree to requests to share Customer Due Diligence information, AICWA’s ongoing work to seek clarification from AUSTRAC, and continued collaboration with REIWA on the concerns being raised by members.

AICWA has released a new AML/CTF Tranche 2 Guidance Notice for members, covering Customer Due Diligence, information sharing and reliance arrangements.
The notice has been prepared by the AICWA Council following member enquiries, clarification from LGIRS, legal advice and careful consideration of how the Commonwealth AML/CTF legislation interacts with the Western Australian settlement agents legislative framework.
The document includes:

🔸 practical guidance for members

🚨 Could your client’s visa status impact their property transaction?
If your client is not an Australian citizen, their visa details may matter more than they realise.
The Department of Home Affairs’ VEVO service lets visa holders and approved organisations check current visa details and conditions, including visa type, expiry date and stay conditions.
For conveyancers, a VEVO check can help flag when visa status may be relevant to the transaction, including whether FIRB requirements or further legal advice should be considered.

Tranche 2 begins today.
For settlement agencies, the focus now shifts from preparation to implementation.
Keep your process practical, consistent and well documented. Make sure staff know where to find guidance, how to explain requirements to clients, and when to escalate concerns.
